Terms of Service – Conditions of Use and Agreement

Delivery times are estimates only and are not guaranteed. Delivery may be delayed due to carrier operations, product availability, customs processing, weather, safety incidents, holidays, high-volume periods, export or import review, force majeure events or other circumstances outside our control. 

International orders, where enabled, may be subject to customs fees, taxes, duties, brokerage fees, import charges, inspections, documentation requirements and delays imposed by local authorities or carriers. Unless we expressly state otherwise, you are responsible for such charges and for complying with all import, customs and local requirements applicable to the shipment and use of the products. 

Risk of loss and title to products pass to you when we or our fulfillment provider transfers the products to the carrier, unless applicable law requires otherwise. You should inspect your shipment upon delivery and contact us promptly if products are damaged, missing, defective or incorrect. 

Certain products, including lithium batteries, drones, radio equipment or products containing hazardous materials, may be subject to additional shipping restrictions, packaging rules, carrier limitations or return limitations. 

7. Returns, Refunds, Exchanges and Warranty Support 

Returns, refunds, exchanges, replacements and warranty support are governed by our Return and Refund Policy, Warranty Policy, product-specific terms, manufacturer terms and applicable law. Please review those policies before placing an order. 

Unless a different policy applies to a specific product, unused items may be eligible for return if they are in the same condition as received, unworn or unused, with tags and original packaging, and accompanied by a receipt or proof of purchase. Items sent back without first requesting a return may not be accepted. 

Certain items may not be returnable, including sale items, gift cards, custom products, personalized or special-order products, personal-care goods, hazardous materials, flammable liquids, gases, used or damaged products, products missing original packaging, and any other products identified as non-returnable on the Website or by applicable law. 

If your return is approved, any refund will generally be issued to the original payment method after the returned product is received and inspected. Banks and payment providers may require additional processing time. 

Warranty terms depend on the manufacturer and the specific product. Some products may include a limited manufacturer warranty covering defects in materials or workmanship. Warranty support may include repair, replacement, store credit or guidance on contacting the manufacturer, depending on the circumstances and applicable manufacturer terms. 

The return, refund and warranty rules in this Section do not limit any mandatory consumer rights that cannot be excluded under applicable law. If merchandise is shipped into the European Union or another jurisdiction that grants a mandatory cancellation or cooling-off right, such mandatory rights apply to the extent required by law. 

8. Product Safety, Drones, Batteries and Regulated Products 

You are solely responsible for using all products safely, lawfully and in accordance with manufacturer instructions, product manuals, warnings, charging instructions, storage instructions and all applicable laws. Products sold through the Website may involve safety, aviation, radiofrequency, battery, electrical, customs, import, export, environmental, privacy or local-use requirements. 

8.1 Drones, FPV components and radio equipment 

Drones, FPV systems, controllers, receivers, video transmitters, antennas, GPS modules, cameras, flight electronics and similar products may be subject to aviation, radiofrequency, registration, remote identification, airspace, privacy, surveillance, safety and local operating rules. You are responsible for understanding and complying with all rules that apply to purchase, assembly, configuration, operation, transmission, modification, transportation and storage of such products. 

You must not use products purchased from Zaruba Store for unlawful surveillance, harassment, privacy violations, trespass, interference with emergency services, unsafe flight, unlawful military or weapons-related use, sanctions evasion, export violations or any purpose prohibited by applicable law. 

8.2 Batteries, chargers and hazardous materials 

Lithium batteries, battery packs, chargers and power-related accessories can present fire, explosion, leakage, electric shock, personal injury and property-damage risks if misused, overcharged, damaged, punctured, exposed to moisture or extreme temperatures, modified, stored improperly or used with incompatible products. 

To the fullest extent permitted by law, you assume the risks associated with improper use, storage, charging, transportation, modification or disposal of batteries, chargers and related products. 

9. Export Compliance, Sanctions and Restricted Use 

Zaruba Store currently understands that it does not sell controlled or dual-use items. However, because the Website sells or may sell drones, batteries, cameras, GPS modules, video transmitters, receivers, controllers, flight electronics, chargers and other technology products, products may be subject to U.S. and non-U.S. export, import, sanctions, customs, product safety, radiofrequency, aviation or other compliance requirements depending on the product, destination, end user and end use. 

You agree to comply with all applicable export control, sanctions, customs, import, anti-boycott and trade compliance laws and regulations, including, where applicable, laws administered by the U.S. Department of Commerce Bureau of Industry and Security, the U.S. Department of the Treasury Office of Foreign Assets Control, U.S. Customs and Border Protection, and any other relevant authority. 

You represent, warrant and agree that: 

Zaruba Store may screen, block, suspend, refuse, cancel or delay any order, shipment, account or transaction if we determine, or reasonably suspect, that a transaction may violate applicable law, product restrictions, shipping limitations, sanctions, export control rules, customs requirements, carrier requirements, payment rules or these Terms. We may also request additional information before processing or shipping an order. 

Nothing on the Website constitutes legal, export, customs, aviation, product-safety or technical compliance advice. You are responsible for determining and obtaining any license, permit, registration, authorization, classification, approval, documentation or compliance review required for your purchase, import, possession, operation, resale, export, re-export or transfer of any product. 

The Website is not intended for sales to U.S. government users, U.S. government contractors or subcontractors, or procurement for government use unless Zaruba Store expressly agrees in writing and any required procurement, compliance, cybersecurity, origin, supply-chain, export, sanctions or other requirements are satisfied. 

10. Permitted Use and Prohibited Conduct 

Subject to your continued compliance with these Terms, Zaruba Store grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the publicly available portions of the Services for lawful personal shopping, account, support and informational purposes. 

You agree that you will not, directly or indirectly: 

11. Intellectual Property, Feedback and User Content 

The Services and all content displayed on or made available through the Services, including text, product descriptions, graphics, photographs, images, illustrations, logos, icons, audio, video, software, code, user interface, design elements, layout, arrangement, trademarks, trade dress and other materials (collectively, "Website Content"), are owned by Zaruba Store, Shopify, their affiliates, licensors, suppliers or other rights holders and are protected by intellectual property and unfair competition laws. 

Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, display, perform, publish, republish, download, store, transmit, sell, resell, license, sublicense, create derivative works from, or otherwise exploit the Services or Website Content without our prior written permission or the permission of the applicable rights holder. 

Zaruba Store names, logos, product or service names, designs and slogans are trademarks or trade dress of Zaruba Store or its affiliates or licensors. Other names, logos, product names, service names, designs and slogans appearing on the Services are the property of their respective owners. 

If you submit reviews, comments, questions, ideas, feedback, suggestions, photos, videos or other content (collectively, "User Content"), you represent that you own or have the necessary rights to submit it and that it does not violate law or third-party rights. You grant Zaruba Store a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, modify, publish, translate, distribute, display, perform and otherwise exploit such User Content for any lawful business purpose, including operating, improving, advertising and promoting the Services and products. 

We may remove, edit or decline to display User Content at our discretion. You remain solely responsible for your User Content. 

12. Third-Party Tools, Links, Shopify and Service Providers 

The Services may include or rely on third-party tools, apps, links, payment services, shipping services, analytics, advertising technologies, social media features, messaging links, embedded content or other third-party resources. We do not control all third-party resources and are not responsible for their content, availability, security, privacy practices, terms, accuracy or performance. 

Zaruba Store is powered by Shopify, which enables us to provide storefront, checkout and related Services. Sales and purchases you make through the Website are made with Zaruba Store, not Shopify, unless expressly stated otherwise. By using the Services, you acknowledge that Shopify and other third-party service providers may process information or provide infrastructure necessary for the Services. 

Your use of third-party resources may be subject to separate third-party terms and privacy notices. You should review them before using third-party services or providing information to third parties. 

13. Privacy, Cookies and Notice at Collection 

Our collection, use, disclosure, retention and protection of personal information are described in our Privacy Notice. Our use of cookies and similar technologies is described in our Cookie Notice. By using the Services, you acknowledge that you have read the Privacy Notice and Cookie Notice. 

Where required by applicable law, non-essential cookies and similar technologies should be used only according to your choices. The recommended cookie choices include Accept all, Reject non-essential and Customize, with necessary cookies remaining enabled because they are required for the Website to operate. 

For California and other U.S. residents, our Privacy Notice may include a Notice at Collection describing the categories of personal information collected, the purposes of collection, retention criteria and whether certain information may be sold or shared for targeted advertising or similar purposes under applicable law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, WEBSITE CONTENT AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" EXCEPT AS EXPRESSLY STATED IN WRITING BY ZARUBA STORE OR REQUIRED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY AND QUIET ENJOYMENT. 

We do not warrant that the Services will be uninterrupted, secure, error-free, compatible with your device, free of viruses or harmful components, or that any defects will be corrected. We do not warrant that product descriptions, images, specifications, compatibility information, availability, delivery times or other content will always be accurate, complete or current. 

Some jurisdictions do not allow certain warranty disclaimers. In those jurisdictions, the disclaimers apply only to the fullest extent permitted by law. 

17. Limitation of Liability 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZARUBA STORE, SHOPIFY, OUR AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, LOSS OF GOODWILL, COST OF SUBSTITUTE GOODS OR SERVICES, PERSONAL INJURY, PROPERTY DAMAGE OR OTHER LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES, PRODUCTS OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ZARUBA STORE FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS BEFORE THE CLAIM AROSE, OR (B) USD 100. 

These limitations do not exclude liability that cannot be excluded under applicable law. 

18. Indemnification 

You agree to indemnify, defend and hold harmless Zaruba Store, Shopify, our affiliates, partners, directors, officers, employees, contractors, agents, suppliers, service providers and licensors from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable attorneys' fees, arising out of or related to:

19. Governing Law and Dispute Resolution 

These Terms and any dispute, claim or controversy arising out of or relating to these Terms, the Services, the Website Policies or products purchased through the Services shall be governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles, except to the extent applicable consumer protection law requires otherwise.
